Florida Car Accident Laws

No Fault State:

The state of Florida is a no-fault state meaning that regardless who was at fault in the accident, both parties have insurance protection. This covers damage to the car as well as medical coverage for injuries sustained by either party in the accident.

MedPay Coverage:

One form of car accident coverage commonly used is MedPay coverage that’s a part of your car insurance policy. MedPay has a lower limit than personal injury protection coverage, however covers a variety of situations including:

  • Extended hospital healthcare

  • Dental care

  • Prosthetic limb coverage

  • Funeral expenses

Car Accident Personal Injury Protection Coverage

How to qualify for PIP:

If you’ve been in a car accident you need to seek treatment right away to get the proper documentation to provide to your insurance agency. Anyone involved in a car accident, including those at fault in the accident, is eligible for PIP insurance in the State of Florida. However, to qualify for PIP insurance there are time frames after the accident that need to be met.

How much are PIP insurance policy limits?:

In the state of Florida you may be entitled to a minimum of $10,000 in personal injury protection benefits and lost wages that resulted from your car accident.

Documentation Needed for PIP:

When utilizing personal injury protection coverage for your car accident injuries, you’ll need to ensure that your car accident and treatment are well documented. The first documentation you’ll need is a police report of the accident. Once you have the police report, you’ll also need to get an initial exam within a 14 day window required by PIP.

Time Frame to Utilize PIP Insurance:

As of 2012 under Florida’s no-fault auto insurance laws you have a 14 day window after the date of your accident to seek treatment. If you do not seek treatment within the 14 day window you’ll lose access to your personal injury protection coverage for that accident.
